Terms of Service
TitleCheckPro · a service of Homz Realty Corporation
The short version
- TitleCheckPro compares the property documents you upload and tells you where they don't agree. A person reviews every report.
- It is a screening. It is not a title verification, a Registry of Deeds search, a survey, a hazard certification or legal advice.
- Your purchase decision is yours. Get a Certified True Copy of the title and professional advice before you buy.
- If something goes wrong, the most we owe you is what you paid for that report.
- Refunds follow our Refund Policy. Your data is handled under our Privacy Policy.
1. About these terms
These terms are an agreement between you and Homz Realty Corporation ("TitleCheckPro", "we", "us"), Unit 207 Goland Plaza, Malvar Street, San Miguel, Puerto Princesa City, Palawan 5300, Philippines, for the use of titlecheckpro.app and the reports we provide.
When you tick the declaration and press "Continue to payment", you accept these terms electronically, which is valid under the Electronic Commerce Act (Republic Act No. 8792). Our Privacy Policy and Refund Policy form part of these terms.
2. Who can use TitleCheckPro
You must be 18 or older. You can order a report:
- for a property you are thinking of buying, or
- on behalf of a client, for example as a real estate broker, agent or lawyer. You then confirm that you have your client's authority to share their documents with us, and that you'll pass these terms, especially section 5, on to them.
We check titled properties anywhere in the Philippines. Hazard screening depends on public government data being available for the area (see section 3).
3. What you get
Document Consistency Report
- A reading of what each uploaded document says on its face.
- A comparison across the documents of the registered owner's name, lot and block number, area and property address, with a written list of inconsistencies found.
- A lot sketch drawn from the title's technical description (a reference sketch, not a survey plan).
- The lot plotted on Google Earth imagery, placed by our reviewer.
Document Consistency Report + Hazard Screening. If you already have a Document Consistency Report on the same property, you can upgrade by emailing orders@titlecheckpro.app and pay only the difference between the two prices:
- Everything in the Document Consistency Report, plus
- a preliminary hazard screening from publicly available government geospatial data: flood, storm surge, landslide and road access, with distances to nearby landmarks and a check of the barangay boundary; and
- the lot boundary as a Google Earth file (KML).
Delivery. We email the report to the address you give us within one working day of payment (Monday to Friday, excluding Philippine public holidays). A person reviews every report before it is sent. The documents are also read with automated tools, including AI (see the Privacy Policy).
4. What a report is not
The report reads only the documents you upload and compares them with each other. It is not:
- a verification of title, ownership, authenticity or legal validity;
- a Registry of Deeds search or a Certified True Copy;
- a survey, relocation survey, appraisal or valuation;
- a hazard certification, or a guarantee that a property is safe, buildable or free of problems;
- legal, tax or financial advice, or the work of a licensed real estate practitioner, geodetic engineer or lawyer.
A report that finds no inconsistency means only that none was found among the documents you uploaded, for the details compared. It does not mean the documents are genuine or the property is free of claims, liens, encumbrances or hazards.
Lot sketches, map plots and hazard screenings are indicative. They depend on the accuracy of the title's technical description, satellite imagery (which may be out of date), and third-party government data we don't control.
5. Your decision, your responsibility
Any decision to buy, pay a deposit, invest in, develop or otherwise act on a property is yours alone. Before you do, it is your responsibility to:
- obtain a Certified True Copy of the title from the Registry of Deeds;
- verify the property with the appropriate government offices; and
- get advice from a licensed real estate practitioner, geodetic engineer and lawyer as needed.
This is the same declaration you tick before payment.
6. What you agree to
When you upload documents, you confirm that:
- the documents were lawfully obtained, and you have the consent or other lawful basis under the Data Privacy Act (RA 10173) to have the personal data in them processed;
- to the best of your knowledge, the documents are what they appear to be, and you are not using the service to create, test or pass off forged documents;
- your email address is correct. We aren't responsible for reports sent to an address you mistyped;
- you won't upload anything unlawful, harmful (such as malware), or unrelated to a property transaction;
- you won't try to disrupt, copy or reverse-engineer the service.
7. When we may refuse or cancel an order
We may refuse or cancel an order, with a full refund, if:
- the documents appear forged or unlawfully obtained, or the order appears connected to fraud;
- the uploads aren't a property document set, or are for a purpose outside this service;
- the property is too complex for a screening, for example a very large or multi-title estate. We may suggest a full due-diligence engagement instead;
- we have temporarily paused orders.
Where the law allows, we may report suspected fraud to the proper authorities.
8. Prices, payment and promo codes
- Prices are in Philippine pesos and may change at any time. You pay the total shown before payment, and later changes don't affect a paid order.
- Payment is processed by PayMongo (card, GCash, Maya or GrabPay). PayMongo's own terms apply to the payment.
- Promo codes: one per order, not exchangeable for cash, cannot be combined, and may expire or be withdrawn.
- Official receipts: email orders@titlecheckpro.app with your order reference to request an official receipt.
9. Refunds and corrections
Refunds, cancellations and corrections follow our Refund Policy. In short: a full refund if we're late or can't read your documents, cancellation before review starts, and a free correction if we misread a document.
10. Using the report
The report is prepared for your transaction. You may share it with family, co-buyers, your lawyer, bank, broker or other advisers for that transaction. You may not:
- republish, sell or post the report publicly;
- alter it, or remove its disclaimers; or
- present it as a title verification, certification or legal opinion.
TitleCheckPro's name, logo, website and report format belong to Homz Realty Corporation. We own the report's layout and wording. The facts about your property and your documents are not ours.
11. Limits on our liability
- We prepare every report with reasonable care, but we don't guarantee that documents, government data or imagery are accurate or complete.
- To the extent the law allows, our total liability for any claim about a report or order is limited to the amount you paid for that order.
- We aren't liable for indirect or consequential losses, including a lost deposit, a lost purchase, lost profit, or a decision made based on a report. This follows sections 4 and 5.
- Nothing in these terms limits liability that can't be limited under Philippine law, including liability for fraud, bad faith or gross negligence, or your rights under the Consumer Act of the Philippines (RA 7394).
12. If you break these terms
If you upload documents unlawfully or use the service in breach of section 6, you are responsible for the resulting claims, penalties or losses against us. That includes claims by the people named in the documents.
13. Things outside our control
We aren't responsible for delays caused by events beyond our reasonable control. Examples are outages at our providers (hosting, AI, payment, email), internet or power failures, natural disasters, or government action. If a report is delayed this way, the late-report refund in the Refund Policy still applies.
14. Disputes
- Talk to us first. Email orders@titlecheckpro.app with your order reference and what went wrong. We'll both try in good faith to resolve it within 30 days.
- If it isn't resolved, either side may go to court. These terms are governed by the laws of the Republic of the Philippines, and disputes go to the courts of Puerto Princesa City, Palawan.
- Nothing here stops you from using small claims procedures or filing a complaint with the Department of Trade and Industry or the National Privacy Commission.
15. Changes to these terms
We may update these terms. The version in force when you paid applies to your order. We'll show the "last updated" date below and a notice on the website for significant changes.
16. General
- If any part of these terms is found unenforceable, the rest still applies.
- If we don't enforce a term right away, we haven't given up the right to enforce it later.
- These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about the service.
